❌ Account Sharing: Sharing your account credentials with others or allowing multiple people to use a single account

❌ Illegal Activities: Any activity that violates French law or international law

❌ Misrepresentation: Providing false information or impersonating others

❌ Reverse Engineering: Attempting to reverse engineer, decompile, or extract our source code

❌ Automated Access: Using bots, scrapers, or automated tools to access our service

❌ Harassment: Harassing, threatening, or abusing other users or our staff

Violation of these prohibitions may result in immediate account termination without refund.

4. Service Description

Looksmaxing App provides:

Facial Analysis: AI-powered analysis of your uploaded photos

Personalized Recommendations: Customized advice for improving your appearance and confidence

Attractiveness Reports: Detailed reports based on your questionnaire responses and photos

Subscription Plans: Access to premium features through paid subscription tiers

5. User Content

5.1 Photos and Data You Upload

By uploading photos and providing information, you grant us a non-exclusive, worldwide, royalty-free license to:

Analyze and process your photos

Generate personalized reports

Improve our AI algorithms (anonymized data only)

5.2 Ownership

You retain ownership of all content you upload. We will not sell or publicly share your photos without your explicit consent.

5.3 Content Removal

You may request deletion of your photos and data at any time by contacting contact@looksmaxing.app.

6. Disclaimer of Results

6.1 No Guaranteed Results

We are NOT responsible for the results of using our service.

Attractiveness and confidence are subjective. Our recommendations are based on general principles and may not work for everyone. Results may vary significantly.

6.2 Not Professional Advice

Looksmaxing App does NOT provide:

Medical advice

Professional cosmetic surgery consultation

Mental health counseling

Guaranteed improvements in dating or social success

For professional advice, please consult qualified experts.

7. Intellectual Property

All content on Looksmaxing App, including but not limited to:

Software code

Algorithms

Design elements

Logos and trademarks

Text and graphics

...are the exclusive property of Looksmaxing App and are protected by copyright and intellectual property laws.

You may not copy, modify, distribute, or create derivative works without our written permission.

8. Subscriptions and Payments

8.1 Payment Terms

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method.

8.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

For plans under €20: No advance notification will be sent before renewal.

8.3 Cancellation

You can cancel your subscription at any time via the app settings. Cancellation takes effect at the end of the current billing period.

8.4 Refund Policy

Refunds are subject to our separate Refund Policy. See REFUND_POLICY.md for details.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through the app settings.

9.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

Violate these Terms

Engage in fraudulent activity

Abuse our service or staff

Fail to pay subscription fees

9.3 Effect of Termination

Upon termination:

Your access to premium features will be revoked

Your data will be deleted within 30 days (unless legally required to retain)

No refunds will be issued for partial billing periods (except as stated in Refund Policy)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Looksmaxing App and its owners, employees, and affiliates shall NOT be liable for:

Indirect, incidental, or consequential damages

Loss of profits, data, or business opportunities

Personal injury or psychological harm resulting from use of our service

Errors, bugs, or service interruptions

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless Looksmaxing App from any claims, damages, or expenses (including legal fees) arising from:

Your violation of these Terms

Your misuse of the service

Infringement of third-party rights

12. Changes to Terms

We may update these Terms from time to time. We will notify you by:

Sending an in-app notification

Continued use of the service after changes become effective constitutes acceptance of the new Terms.

These Terms are governed by the laws of France.

Any disputes arising from these Terms or use of our service shall be resolved in the courts of France.
